Massage therapist captivated “friend” Mel Gibson over alleged assault during massage with Harvey Weinstein

Actress Mel Gibson once played the trusted confidant of one of Harvey Weinstein’s accusers, and the woman testified in court this week during the disgraced mogul’s criminal trial for rape.

Los Angeles County prosecutors charged Weinstein with 11 counts of sexual assault over allegations from five different women who accused the one-time producer of mistreating them in Los Angeles hotels between 2004 and 2013.

Weinstein is already serving a 23-year sentence in a New York prison following his East Coast trial but faces an additional life sentence en route to West Coast proceedings. He denied the charges and pleaded not guilty.

The five women are expected to testify against Weinstein, as well as four “former witnesses to misdeeds,” whose testimony is not directly related to the criminal charges but may be considered by the jury when prosecutors attempt to prove Weinstein’s alleged pattern of behavior.

One of the main defendants in the case stood on Wednesday where she described the alleged assault. The woman, identified as Jane Doe 3, worked as a massage therapist catering to high profile clients and celebrities, which is why she became lonely in a hotel room with Weinstein in 2010, according to an Experience Pool report.

She testified that after 40 minutes at the table, Weinstein abruptly stopped the massage, saying it was over. She testified that she went to the bathroom to wash her hands when Weinstein barged in and started masturbating. Jane Doe 3 said she asked him to leave, and told him that his behavior was inappropriate.

She testified, according to the pool report: “He said, ‘Look at me, tell me how big my penis is.'”

She said he pushed her against the wall and started feeling her chest under her bra. She said that despite her pleas, Weinstein continued to touch her and masturbate. When finished, he tried to play the incident as normal, and Jane Doe 3 testified, according to a pool report.

For several months, she said she kept assaulting herself out of fear that speaking out would affect her career and access to high-profile massage clients. But she eventually revealed the alleged attack of an unlikely friend.

Jane Doe 3 said she was giving a massage to actor Mel Gibson when he brought out a movie he might be working on with Weinstein. She said she was starting to “freak out,” wondering how Gibson might want to work with Weinstein. When he asked her how she would react, she and his family began crying about the assault, she said.

“He was the first person I finally opened up about what happened,” she said, according to the pool report. “I told him he sexually assaulted me, but I didn’t want to go into all the details. I felt embarrassed and humiliated.”

I asked Gibson if she wanted to call the police. She also testified that he suggested she talk to one of his girlfriends.

A Gibson representative did not immediately respond to Insider’s request for comment.

Prosecutors said they plan to call Gibson as a witness in the case, but Weinstein’s defense attorney said he would invoke the actor’s volatile and anti-Semitic history if he took the stand.

During Thursday’s cross-examination, Weinstein’s attorney, Mark Werksman, pushed Jane Doe 3 to explain why she went back to massaging Weinstein several times after the initial incident and entered into discussions with his publishing company about a possible nude massage book.

“Your story is like the American economy, with an inflation rate of 8%,” Werksman said. “You didn’t want to end the book deal and tell Weinstein, ‘Bad boy, no more rubs’, did you?”

Werksman claimed that Jane Doe 3’s story changed during meetings with the Los Angeles County District Attorney’s office and authorities between 2016 and 2020.

“That’s one of the reasons why I don’t want to come forward,” she said. “Because this is embarrassing.”
